Collerans respect your right to privacy and comply with our obligations under the Data Protection Acts 1988 and 2003. The purpose of this Website Privacy Statement is to outline how we deal with any personal data you provide to us while visiting this website. Types of Information Collected

As a result of those actions, you might supply us with such information as your name, address and phone number etc.

Automatic Information

Examples of the information we collect and analyze include the Internet protocol (IP) address used to connect your computer to the Internet, login, e-mail address, computer and connection information such as browser type and version, your operating system and platform, purchase history, which we sometimes aggregate with similar information from other customers to create features the full Uniform Resource Locators (URL), through and from our website (including date and time), cookie number and products/vehicles/editorial you viewed or searched for.
What Choices Do I Have?

  • As discussed above, you can always choose not to provide information, even though it might be needed to make a purchase or to take advantage of certain features.

Indemnity and Waiver

You hereby agree to indemnify and keep indemnified COLLERANS its successors and assigns and each of its respective directors, officers, employees and agents from and against any and all liability, damages, losses, claims (including reasonable legal fees) resulting in any way from your use of the information and material posted on the COLLERANS web site or resulting from any breach of this Agreement whether such breach is carried out by you, your use of the COLLERANS web site, your connection to the COLLERANS web site or your violation of any third party rights. Furthermore, you hereby acknowledge that any material downloaded or otherwise obtained through the use of the COLLERANS web site is done at your own discretion and risk and that you waive any right to bring any claim or action against COLLERANS or its successors, assigns, directors, officers, employees and agents for any loss, damage or injury arising from your access to or use of the COLLERANS web site.

You hereby agree to indemnify and keep indemnified COLLERANS its successors and assigns and each of its respective directors, officers, employees and agents from and against any and all liability, damages, losses, claims (including reasonable legal fees) resulting in any way from any such publication, posting, uploading, distribution or dissemination of any such material or information on the COLLERANS web site.

Assignment
COLLERANS reserves the right to assign or subcontract any or all of its rights and obligations under this Agreement.

Modifications to COLLERANS web site
COLLERANS reserves the right at any time and from time to time to modify or discontinue temporarily or permanently, the COLLERANS web site (or a part thereof) with or without notice. You agree that COLLERANS shall not be liable to you or any third party for any modification, suspension or discontinuance of the COLLERANS web site. COLLERANS shall not be liable to you or any third party should COLLERANS exercise its right to modify or discontinue the COLLERANS web site.

Entire Agreement
This Agreement constitutes the entire Agreement between you and COLLERANS and supercedes any prior agreements, arrangements, statements and understandings between COLLERANS and you.

Waiver

A waiver by COLLERANS of any breach by you of any of the terms, provisions or conditions of this Agreement or the acquiescence of COLLERANS to any act (whether of commission or omission) which but for such acquiescence would be a breach as aforesaid shall not constitute a general waiver of such term, provision or condition or of any subsequent act contrary thereto.

Invalidity

If at any time any one or more provisions of this Agreement shall be held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions of this Agreement shall continue in full force and effect.

Dissatisfaction

If you are dissatisfied with the COLLERANS web site or any information posted thereon, or with any term or condition of this Agreement, your sole and exclusive remedy is to discontinue using the COLLERANS web site.

Governing Law

This Agreement shall be governed by Irish law and you hereby consent to the exclusive jurisdiction of the Irish courts in all matters regarding it.

Our Remuneration/Commission/Fees

Colleran Auctioneers & Insurance Brokers act as intermediary between you, the consumer and the product provider with whom we place your business.

Background

Pursuant to provision 4.58A of the Central Bank of Ireland’s September 2019 Addendum to the Consumer Protection Code, all intermediaries must make available in their public offices, or on their website if they have one, a summary of the details of all arrangements for any fee, commission, other reward or remuneration provided to the intermediary which it has agreed with its product producers.

Remuneration is the payment earned by the intermediary for work undertaken on behalf of both the provider and the consumer.  The amount of remunerations generally directly related to the value of the products sold.

Commission is payment that may be earned by an intermediary for work undertaken for both provider and consumer. There are different types of remuneration and different commission models.

Single Commission Model: where payment is made to the intermediary shortly after the sale is completed and is based on a percentage of the premium paid.

Renewal Commission Model: further payments at intervals are paid throughout the life span of the product.

General Insurance Products are products, such as motor, home, travel, health, retail or liability insurance, typically subject to a single or standard commission model, based on the amount of premium charged for the insurance product.
